This Privacy Policy explains how we collect, use, and safeguard your data as we operate as a lead generation and marketing service to connect consumers with our network of local spas.

     To do this, we collect contact information from consumers to share with vetted Spa Partners, and we collect professional and business details from Spa Partners for verification and compliance purposes within the network. We do not sell your information for other purposes (see Section 5 for clarification on lead referral). You can opt out of marketing communications at any time.

   This Privacy Policy (“Policy”) describes how Wellness & Care Connection, LLC (the “Agency”) (“we,” “our,” or “us”) collects, uses, and shares information from individuals and businesses who access or use our online platform and website, www.findyourlocalspa.com (the “Website” or "Platform").

          This Policy applies to:

  1. Users (spa seekers, also referred to as “Lead” or “Consumer”) who visit the Website to be connected with a local spa.

  2. Spa Partners (businesses, also referred to as "Spa Associate") who submit information to join our network of participating spas.

By accessing or using the Website, you acknowledge that you have read and agree to be bound by this Policy. If you do not agree with any part of it, please refrain from using the Website. You may exercise your privacy rights by accessing the Your privacy rights link located in the footer of our Website.

 We may update this Policy, and your continued use of the Website means you accept the changes.

    We collect personal and business information to deliver, improve, and personalize our services. This information may be obtained in the following ways:

                      1. Directly from you, when you complete forms, register, or communicate with us

B. Information from Spa Partners (Associates)

  3. Contact details of key personnel.

  5. Verification documents used for compliance and quality assurance.

While we may collect and review professional and business information for verification and compliance purposes, we do not guarantee the accuracy, completeness, or legitimacy of any information provided by Spa Partners. Such information is provided by the Spa Partners themselves and may be subject to independent verification by Users.

A. With Spa Partners

To fulfill your request, we share relevant personal information with vetted Spa Partners. Their use of your data is governed by their own privacy policies.

2. Lead generation and business referrals: Our Spa Partners compensate us for qualified leads. Because this involves sharing your personal information in exchange for financial or other valuable consideration, it may be considered a "sale" of personal information under certain state privacy laws, such as the California Consumer Privacy Act (CCPA) and the Texas Data Privacy and Security Act (TDPSA).

3. Targeted advertising: Showing you relevant offers and promotions based on your interests, browsing activity, and online behavior.

4. Cross-context behavioral targeting: Using your data across different services or websites to deliver personalized promotions and improve your experience.

Important Note on "Sale" of Personal Information: While we do not sell your data to unrelated third parties for marketing purposes, the sharing of your information with Spa Partners as part of our lead referral service may legally constitute “sale" under applicable laws.     Find Your Local Spa and Wellness & Care Connection, LLC operate solely as digital intermediaries, facilitating connections between Users and independent spa and wellness service providers (“Spa Partners”). We are not a party to, and do not participate in, any agreement, transaction, or service arrangement between a User and a Spa Partner.

    A. No Responsibility for Third-Party Services

    Accordingly, we do not assume and expressly disclaim any responsibility or liability for:

          1. The quality, pricing, availability, safety, legality, or outcomes of services provided by Spa Partners;

          2. Any promotions, discounts, representations, or communications made by Spa Partners or other third parties; and

         3. Any personal injury, property damage, financial loss, or other harm arising from or occurring at a Spa Partner’s location or in connection with their services.

        B. Limitation of Liability

    To the fullest extent permitted by applicable law, we shall not be liable for any direct, indirect, incidental, special, consequential, punitive, or exemplary damages arising out of or related to:

    1. Your access to or use of the Website or Platform;

    2. Any communications, interactions, or transactions between you and any Spa Partner;

    3. Any dispute, claim, or controversy between Users and Spa Partners; or

    4. Any third-party websites, services, or content accessed through the Platform.

    This clause does not limit or exclude liability that cannot be excluded under applicable law.

        

      11. Data Retention

      We retain personal and business information only for as long as necessary to fulfill the purposes outlined in this Privacy Policy, or as required by applicable laws and regulations. Retention periods vary depending on the type of data and its intended use.

      A. How Long We Retain Data

          1. Lead-Matching Data

      Information provided by users for spa matching (such as name, contact details, and zip code) is retained for up to 15 days to fulfill spa requests and improve services. After this period, the data is either anonymized or securely deleted, except where it is retained for the limited purposes of surveys or notifications as described in Section 11(A)(2).

      2. Surveys and Notifications (User/Lead Data)

      If you provide your information as a lead, we may send you limited follow-up communications such as surveys or service-related notifications by email or SMS (for example, a survey sent 10–11 days after your initial request). This data may be retained for a short period beyond the 15-day lead-matching period solely for the purpose of delivering such communications and processing responses. You may opt out of receiving further SMS communications at any time and may unsubscribe from non-essential emails.

           3.  Spa Partner Information
      Information related to Spa Partners is kept for the duration of our business relationship and for legal, operational, or compliance needs.

           4.  Other Personal Data
      We keep other personal data for a reasonable period to support platform functionality, or as required by law.

           B. Data Deletion Requests

      You may request deletion of your personal information at any time. We will process such requests in accordance with:

      12. Data Security
